The www.feria.sncf.com Platform (hereinafter “the Platform”) is published by “SNCF VOYAGEURS SA – Direction “Voyages SNCF”, public limited company, registered in the Trades and Companies Register of Bobigny under the number 519 037 584, the head office of which is Seine-Saint-Denis, at 9 rue Jean-Philippe Rameau, Saint-Denis, France.

The Publication Director of the Platform is Christophe FANICHET, Chief Executer Officer of SNCF Voyageurs.

Production, hosting and maintenance of the Platform are provide by the company JOUVE, simplified joint stock company with capital of €3,756,343.78, registered in the commercial register of LAVAL under the number 582131264, the head office of which is at 1, rue du docteur Sauvé, 53100 Mayenne, France represented by Mr Thibaud Lanxade, acting as Managing Director, duly authorised to do so.

 

FERIA General Terms and Conditions of Use

March 2021

 

PREAMBLE

The purpose of these General Terms and Conditions of Use (hereinafter the GTCU) is to set out the conditions of access and rules of use of the “FERIA” Platform for travel agency information and training on the Voyages SNCF offer accessible via the following link: www.feria.sncf.com.

Access to the Platform is subject to compliance with the GTCU and is strictly reserved for the User as defined hereinafter.

When the User accesses the Platform for the first time, a window containing the GTCU is displayed. The User must accept them by ticking the box: “I have read the General Terms and Conditions of Use and the Personal Data Protection Policy and cookies of the FERIA Platform in full and accept them”.

The Publisher reserves the right to amend these GTCU as changes or additions are made, in order to comply with any legal, case-law, editorial and/or technical changes.

Each time the GTCU are updated by the Publisher, the User will receive an email from the Publisher to inform them of this. In the event of substantial changes to the GTCU, the User must accept the new GTCU by ticking the box “I have read the General Terms and Conditions of Use and the Personal Data Protection Policy of the FERIA Platform in full and accept them” when they log in to the Platform.

The User may access these GTCU and the personal data protection policy at any time at the bottom of the page on the FERIA Platform.

If the User does not accept the GTCU, they will not be able to access the Platform.

 

ARTICLE 1 – DEFINITIONS

In these GTCU, words or phrases starting with an uppercase letter, in the singular or plural, will have the following meaning:

Platform: refers to FERIA, the Platform proposed by the Publisher that is accessed by way of an Internet browser via the address www.feria.sncf.com, developed to be useable from computers and mobile devices, the purpose of which is given in article 2.

Account: refers to the space created by the User to access the Website and/or the App.

Publisher: refers to “SNCF VOYAGEURS SA – Direction “Voyages SNCF”, public limited company registered in the Trades and Companies Register of Bobigny under the number 519 037 584, the head office of which is in Seine-Saint-Denis, at 9 rue Jean-Philippe Rameau, Saint-Denis, France.

Hosting company: refers to JOUVE, simplified joint stock company with capital of €3,756,343.78, registered in the commercial register of LAVAL under the number 582131264, the head office of which is at 1, rue du docteur Sauvé, 53100 Mayenne, France, represented by Mr Thibaud Lanxade, acting as Managing Director, duly authorised to do so.

Information: means all information and publications accessible on the Platform.

User(s): refers to any person with the authority to access the Platform, that is:

  • staff of a travel agency by way of an approval contract entered into with “SNCF Voyages” SA (PLC) – Direction “Voyages SNCF” (Voyages SNCF Division) – Direction “Entreprises et Agences de Voyages” (Business and Travel Agencies Department) (a travel agent manager, travel agent, travel agent accountant administrator, travel agent assistant accountant, network ambassador)
  • an external visitor belonging to a tourism school (called “school profile” in this document) by way of an access request on the Platform or by email
  • an internal visitor of GPF SNCF (by distinguishing administrators from other Users) who can make their request on the Platform or by email

 

And having access to the Platform regardless of where they are located or the means of connection.

 

ARTICLE 2 – PLATFORM PURPOSE

The purpose of the Platform is to inform, provide training on Voyages SNCF offers (via the software “360LEARNING” which has its own GTCU to be approved directly by accessing its website and the software "Globwl" which has its own GTCU that you can consult directly on its website), enable certain Voyages SNCF products to be booked, to have access to the “PréFERence” activity programme website (which has its own GTCU that you can consult directly on its website).

 

All use of the Platform"FERIA" will be carried out in compliance with these GTCU.

 

ARTICLE 3 – PLATFORM ACCESS AND USE

3.1 Access to the Platform

The Platform can be accessed via a computer, a tablet or a smartphone connected to a telecommunications network using Internet communication protocols.

The Publisher grants the User a right to browse, use and access the Information on the Platform.

3.2 Access cost

Access to the Platform is free of charge and no subscription is required. All the software and equipment needed to use or operate the Platform, access to the Internet and the communication costs are the User’s exclusive responsibility outside of their workplace.

Each User is fully responsible for their own connection data. Without evidence to the contrary, any connection to the Platform, or data transfers made using the User’s connection information, will be deemed to have been made by them.

3.3 Duration of accessibility

Access by the User to the Platform is carried out throughout the total duration of the approval contract signed between the travel agency and “SNCF Voyages” SA (PLC) – Direction “Voyages SNCF” (Voyages SNCF Division) – Direction “Entreprises et Agences de Voyages” (Business and Travel Agencies Department) except for the other Users the duration of which is for an unlimited duration, without prejudice to the power for the User or the Publisher to cancel this Contract.

The User acknowledges that in the event of a breach of the legislative provisions and/or these GTCU, the Publisher may block and/or cancel access to the Website, with immediate effect.

3.4 Use of the Platform

The User will refrain in particular:

  • from using the Platform for commercial purposes and generally from offering products or services which remunerate them directly or indirectly;
  • “reselling” or making available to a third party and/or other Users the Platform’s content, for a fee and/or free of charge;
  • from using the Platform in order to communicate, in any form, advertising or elements of an unsolicited promotional nature;

3.5 Information and functionalities provided

The Platform gives the User the possibility:

  • to find out about Voyages SNCF offers (“school" profile Users do not have access to the Platform’s promotions)
  • to learn about the Voyages SNCF offers (all Users except “network ambassadors” and “GPF SNCF internal” Users other than “administrators”) via the “360Learning” software that we provide for the use of the User. By accessing this software, data with your email, last name, first name and training language are transmitted to this software which has its own General Terms and Conditions of Use to be approved directly on this website by accessing it. The conditions of access and use of the "360Learning" software are the responsibility of the company "360 Learning SA" (public limited company with share capital of 189,279.30 euros, registered in the Paris Trade and Companies Register under the number 512 663 733, with its registered office at 37 rue des Mathurins in Paris (75008)). To participate in virtual classes (distance learning), the User will be invited to connect to the “Globwl” platform. The conditions of access, use and protection of data relating to this platform are governed by the company "Glowbl" (a company incorporated under French law, whose head office is located at 81 rue d'Inkermann, 69006, Lyon, France , operating the glowbl.com site, hereinafter referred to as "GLOWBL") which you can find on the site of this platform.
  • to receive various Newsletters:

- “FERIA SCOOP” occasionally distributing “Voyages SNCF” information/news (all Users except school "profiles” and “accountant” profiles of an agency"). “FERIA SCOOP” with “accountant” information are only sent to a “travel agency’s accountant” profiles
- “FERIA NEWS” regularly distributing information about the “Voyages SNCF” latest news (all the Users except “school" profiles and “accountant” profiles of a travel agency)
- “SavoirFER Express” occasionally distributing “Voyages SNCF” information (only for SNCF internal profiles)
- “SavoirFER News” occasionally distributing “Voyages SNCF” information (only for SNCF internal profiles)

  • to access the after-sale forms (only for travel agency managers, travel agents)
  • to access the “Accounting (DMAT/F access)” part (only for accountant administrators, assistant accountants)
  • to access group booking websites (according to the eligibility of the travel agency), to access a booking site of the “Mon Forfait Annuel” product, to book the offers exclusively sold on the web via RAVEL (for travel agents)
  • to have access to the questions of the week (only for travel agents, agency managers)
  • to follow the anonymous incentives results (only for agency managers and administrators)
  • to order documentation tickets, commercial or accounting forms, SNCF signage (only for travel agents, agency managers)
  • to create or modify User Accounts (the Accounts of their travel agents for the agency manager, the Accounts of the assistant accountants for the accountant administrator, all User profiles for administrators)
  • to undertake agency or User searches (for administrators)
  • to access the “PreFERence” website, our activity programme which has its own General Terms and Conditions of Use (only for travel agents, agency managers according to certain eligibility criteria for the agency, criteria to consult in the Frequently Asked Questions of the FERIA Platform or at the bottom of the page of the FERIA Platform)

 

ARTICLE 4 – PLATFORM AVAILABILITY

The Platform can be accessed 24/7, except in the event of force majeure or temporarily in the event of an new version being rolled out.

The Publisher reserves the right to suspend, interrupt or limit temporarily, access to all or part of the Platform, in particular for maintenance operations and updates required for the proper operation of the Platform and related equipment, or for any other reason, of a technical nature in particular.

The Publisher is not bound by any performance obligation with regard to the availability of the Platform but only an obligation of means. The Publisher disclaims all liability for interruptions or for any resulting consequences for the User when the interruptions are due to those of the Hosting company (SNCF – e-SNCF DEPARTMENT – DIGITAL SERVICES OPERATIONS SERVICE) for its maintenance needs.

 

ARTICLE 5 – PLATFORM HOSTING

Users are expressly informed that the content published on the Platform is hosted and stored on the JOUVE servers.

 

ARTICLE 6 – ACCESS ACCOUNT

6.1 Creating an Account

To access the Platform, the User must have an Account.

The User communicates to the Publisher the personal information required to have access to the FERIA Platform and have access to the different functionalities according to their profile (cf. articles 1 and 3.5): last name, first name, email address. In addition, the User also gives the password when they access the Platform. The User guarantees the Publisher that they have provided information that is correct, true, up to date and complete regarding their identity and contact details. They undertake notably to provide a current professional email address that belongs to them.

The User undertakes to regularly update all of the information relating to their profile, in order to conserve its accuracy, by way of emails from the support services of the Platform.

Should the User provide data that is objectively false, incorrect, out of date or incomplete, the Publisher will have the right to suspend or cancel the User’s Account and to refuse access to the Platform to them in the future.

The reason for the suspension can only be communicated at the request of the User addressed to the email address given below and at the discretion of the Publisher.

The User is solely responsible for any use that may be made of their passwords and user ID (email address or other), and, is the sole guarantor of their confidentiality, as well as any use of their Account.

6.2 Security                                                                                     

The User undertakes to immediately inform the Publisher of any non-authorised use of their Account, and any breach of the confidentiality and security of their identification means by sending a message to the following address: contactferia@sncf.fr.

If the Publisher has legitimate reasons to think that the security of the Platform is threatened or that it is used incorrectly due to non-authorised use of the User’s identification means, they may undertake to temporarily suspend the Account, in order in particular to maintain the integrity of the Platform, and, if it seems appropriate, to require them to change their identification means.

6.3 Deleting an Account

The User is free to delete their Account at any moment. In addition, in the event of the User losing their password, they may go to the homepage of the Platform and click on “Reset password”. The email address registered for the User’s FERIA Account must be input. The Frequently Asked Questions on the Platform give the detail of this procedure and that of other connection difficulties.

The Publisher reserves the right to deactivate the User’s Account following a period of complete inactivity of the Account equal or more than 24 months. However, the User will have the possibility of recreating an Account by returning to the Platform or asking their agency manager.

Likewise, in the event of inactivity on an Account (agency closed, agency suspended, inactive Account) and respecting conserving the data for the 24-month period, the Publisher will be obliged to cancel access to the Platform:

  • in the case where an agency is closed: the Publisher will delete access to the Platform for all Users associated with this agency, within a 12-month period after the day the agency closes.
  • in the case of an inactive Account (that is a User has not connected to the Platform in more than 24 months): the Publisher will definitively delete access to the Platform after having previously sent the User three emails informing them that their account will be deleted if no contact is received from them (new log in on the FERIA website): a 1st email will be sent 1 month before, a 2nd follow-up email will be sent 15 days before and a final email 5 days before their Account is deleted.
  • in the case of a "school visitor" profile, the Account will be permanently deleted 12 months after the creation of the Account.
  • in the case where an agency is suspended, the Users will no longer have, temporarily (for the time of the suspension), access to the FERIA Platform.

 

ARTICLE 7 – INTELLECTUAL PROPERTY

Generally, the User may not infringe the intellectual property rights (copyright, related rights, sui generis right of the producer of databases, trade mark right, domain names, etc.) of the Publisher and/or the Hosting company, and/or any third party.

The Publisher is the holder of all the intellectual property rights both to the structure and the content of the Platform (texts, logos, images, sounds, software, icons, page layout, databases, etc.) or has lawfully acquired the rights to use the structure and content of the Platform, with no limitation.

Therefore, in particular, the User may not copy, reproduce, represent, modify and/or use, transfer in any way or for any purpose, all or part of the structure and content of the Platform, except with the Publisher’s express, prior permission in writing.

Any downloading is strictly prohibited, with the exception of the two following cases:

  • The Publisher’s express permission,
  • The Publisher providing a download link.

 

Any improper downloading that is noted may result in the Publisher and/or any third party concerned, taking repressive measures which are appropriate in this case.

Any downloading of software proposed by the Hosting company on the Platform must respect the Hosting company’s conditions of use. The User must contact the Publisher before any download, in order to find out if the software is among the services the Publisher has subscribed to from the Hosting company.

The User is entirely responsible for the consequences of infringements from any download carried out by the User without having informed the Publisher and/or contravening the Hosting company’s conditions of use.

The trade marks and logos reproduced on the Platform are registered with the competent Offices by the companies which hold them. Any reproduction of the names or logos, by any means, without the prior permission of the relevant holder, is prohibited.

Non-compliance with these prohibitions may, in particular, be an act of infringement and/or unfair and parasitic competition involving the User’s civil and/or criminal liability.

 

ARTICLE 8 – PERSONAL DATA AND COOKIES

All of the rules relative to protection of personal data and cookies are given in a specific policy that can be accessed through this online form

ARTICLE 10 – INVALIDITY OF A CLAUSE

The invalidity in full or in part of one or more provisions of the GTCU resulting from the terms of a legal or regulatory provision or from a judicial decision that has become final, will not result in invalidity of the other provisions or of the part of the provision not vitiated by the invalidity.

 

ARTICLE 11 – APPLICABLE LAW – SETTLEMENT OF DISPUTES

The GTCU are subject to French law.

In the event of disagreements relating to the interpretation, validity or performance of the GTCU, the User and the Publisher agree to use their best endeavours to settle the dispute mutually.

In the event that a mutual solution should not be found, any dispute relating to the interpretation or performance of the GTCU will be referred to the courts of Paris.
